The 3rd Circuit Court of Appeals, after having its opinion remanded back by the Surpeme Court in February, reversed its decision Thursday in support of the Dairy Checkoff.
The court affirmed U.S. Middle District Judge John E. Jones' opinion that Joseph and Brenda Cochran had to pay annual assessments, which amount to about $4,200 per year.
Last year, the appeals court had declared the mandetory assessment unconstitutional based on the First Amendment right of free speech.
"It's more constitutional erosion. I certainly disagree with what they did," Joseph Cochran told The Patriot News after he and his wife, Brenda, lost their two-year fight in court.
