The Center for Race, Poverty and the Environment has a bit of egg on its face today. Last week the group announced it was planning to file suit against a proposed 3,200-cow dairy for not conducting an environmental impact review.

Turns out the proposed dairy they planned to file suit against had already started the process late last summer.

Charles Van Der Kooi, the owner of the proposed dairy, and the San Joaquin Valley Air Pollution Control District started working on an environmental impact review for the dairy that will be located near Riverdale, Calif. last August.
