Earlier this week, a U.S. District Court judge in Fresno, Calif., ruled that C&R Vanderham Dairy violated federal rules when it began construction on its Kern County operation without an air permit.

The San Joaquin Valley Air Pollution Control District had said that the dairy did not need the permit, but the Center on Race, Poverty & the Environment sued. The dairy obtained the permit last April, but apparently that was too late.

The dairy will be back in court in March when a judge will determine fines and penalties.
