Judge throws out Sierra Club lawsuit

Yolo County Superior Court Judge Thomas Warriner has dismissed a Sierra Club lawsuit to stop a dairy expansion on a technicality. The Sierra Club filed the suit in August, missing the deadline to do so by nearly a month.  

The group had filed the suit because it disagreed with the action taken by Yolo County to allow Cache Creek Dairy, near Woodland, Calif., to expand without getting a conditional use permit and an environmental review.

Originally the county denied owner Jack Kasbergen a building permit to expand. However in April, after he filed an appeal and argued his right to complete the build out of the dairy, which began under a different set of rules, the county agreed.
